Faculty of Law UNDIP Inaugurated Two Professors

Prof. Dr. Paramita Prananingtyas, S.H., LL.M. and Prof. Dr. Fifiana Wisnaeni, S.H., M.Hum were officially inaugurated by the Rector of Diponegoro University (Undip) as Professors at the Faculty of Law, Diponegoro University, Tuesday (19/9) at the Prof. Soedarto, S.H. Building, Tembalang.

In her scientific material entitled Compliance Program for Business Competition Law Enforcement (Competition Compliance) as an Effort to Cultivate Legal Compliance for Business Actors in Indonesia: Establishing Healthy Business Competition for a More Advanced Indonesia, Prof. Paramita conveyed the form and process of preparing a compliance program (competition compliance) in Indonesia and other countries are carried out in stages. Fair business competition and anti-monopoly enforcement agencies from countries with anti-monopoly and unfair business competition regulations will first provide the foundation and guidelines for general compliance programs.

“Companies that have implemented a compliance program with competition law will also be ready to comply with competition programs in the company’s business partner countries. The company is aware of the importance of complying with business competition regulations domestically and abroad. Compliance with business competition regulations outside the company’s home country will usually be implemented if the companies have international business networks through direct investment programs and foreign trade programs,” she said.

“The relevance of the existence of a competition compliance program to changes in the behavior of business actors, especially in Indonesia, is that internally, companies that implement a compliance program will gain many benefits, especially in terms of performance, reputation and readiness to face healthy business competition both nationally and internationally,” continued Prof. Paramita.

Meanwhile, Prof. Fifiana raised the title Model of the General Election System for Members of the House of Representatives to Realize a Just Democracy. She said that the electoral system currently in force in Indonesia does not guarantee a just democracy because the Election Law closes the space for political parties in the context of a democratic country. The existence of the Parliament institution creates unclear representation functions, namely that, on the one hand, the members of Parliament represent the aspirations and interests of certain political parties. On the other hand, members of Parliament are elected directly by the people, not by political parties.

“The model for the electoral system for members of the House of Representatives that can realize a just democracy is the proportional electoral system with the Mixed Member Proportional (MMP) variant, which gives the people the opportunity to choose the names of candidates and political parties. The public could also choose a District system with the provisions that electoral districts are based on the population balance. It has to pay attention to the expansion and merging of regions and the method by which votes are counted based on the majority of votes in one round,” she explained. (LW-Public Relations)
